Brunei
trademark registration is under protection in The Trade Marks Act (Cap 98) and
Trade Marks Rules of 2000. If a trademark is registered, the owner gets the
exclusive legal rights to use, sell or license the trademark and to stop others
from using the mark without his permission. In the event of an infringement of
a registered trademark taking place, the owner can take action against the
infringer more easily and effectively compared to if the mark is not
registered.

Trademark Search
Before
filing your trademark in Brunei, it is important that you evaluate possible
obstacles that may arise during the registration process. A Trademark Study
will not only list similar trademarks that may conflict with yours, but also
give you an attorney's opinion about registration possibilities. It is optional
but highly recommended.
Brunei
Trademark Registration Procedure
Tannet
will process your application, check all details, and then file with the Brunei
Intellectual Property Office. You will receive confirmation of filing and a
copy of the filing request. We will contact/email you immediately if any
additional information is needed, or if there is opposition in Brunei against
your application.
After a
formal examination at the Brunei Darussalam Intellectual Property Office
(BruIPO), your trademark will be published to allow third parties to oppose it
if they believe that your mark infringes on theirs. The opposition period in
Brunei is 3-4 months after publication. You will receive status updates as soon
as your mark is published and will be notified of any actions taken by the
Brunei Darussalam Intellectual Property Office (BruIPO). If no oppositions
arise and your trademark is formally approved, you can expect registration
within 12 to 24 months.
